These Terms of Use & Service (“Terms”) govern your use of the North State Hauling – Junk Removal website (the “Website”) and your requests for, purchases of, and use of junk removal, hauling, cleanout, pickup, and related services offered by North State Hauling – Junk Removal (“North State Hauling,” “Company,” “we,” “us,” or “our”).
These Terms, together with any applicable estimate, work order, invoice, booking confirmation, written proposal, or other service-specific terms accepted by the customer (“Customer,” “you,” or “your”), constitute the agreement between North State Hauling and Customer for the applicable services (collectively, the “Agreement”).
By accessing or using our Website, submitting a quote or booking request, scheduling an appointment, approving an estimate, authorizing North State Hauling to begin work, or purchasing our services, you acknowledge that you have read, understood, and agree to these Terms to the extent permitted by applicable law.
If you do not agree to these Terms, please do not use our Website or purchase our services.
These Terms should be read together with our Privacy Policy and any estimate, invoice, work order, booking confirmation, or other written agreement applicable to a particular job.
1. ABOUT NORTH STATE HAULING
North State Hauling provides junk removal, hauling, property cleanout, debris removal, item pickup, and related services within the areas we choose to serve.
Our services may include, depending on the location, materials, property, and circumstances:
Residential junk removal;
Commercial junk removal;
Furniture removal;
Appliance removal;
Garage cleanouts;
Estate cleanouts;
Storage unit cleanouts;
Office and commercial cleanouts;
Rental property cleanouts;
Yard debris removal;
Construction and renovation debris removal;
Single-item pickups;
Bulk-item removal; and
Other hauling, removal, loading, and cleanout services approved by North State Hauling.
The availability of any particular service is not guaranteed.
Our general services do not include specialized demolition, removal of permanent structures, hazardous-material remediation, licensed plumbing, electrical, HVAC, gas, or other specialized trade work unless specifically agreed to in writing and legally permitted.
North State Hauling reserves the right to determine whether we can safely, legally, and reasonably perform any requested service.
2. WEBSITE INFORMATION
We make reasonable efforts to keep the information on our Website accurate and current. However, Website content is provided primarily for general informational purposes.
Descriptions of services, service areas, pricing examples, truck or trailer capacities, accepted materials, promotional offers, estimated job times, availability, and other information may change without notice.
Information displayed on the Website does not, by itself, constitute a binding offer or guarantee that North State Hauling will perform a particular service at a particular price.
A service relationship is created only when North State Hauling accepts or confirms the applicable job or otherwise agrees to provide the requested services.
3. QUOTES AND ESTIMATES
Customers may request estimates through our Website, by telephone, text message, email, photographs, videos, in-person inspection, or another communication method we make available.
Unless North State Hauling expressly states otherwise in writing, estimates are based upon the information reasonably available to us at the time they are prepared.
Remote and Photo Estimates
An estimate based upon photographs, videos, telephone descriptions, text messages, measurements, or other information provided before our arrival may change after we inspect the items and property in person.
Factors that may affect pricing include, without limitation:
Actual volume of material;
Actual weight of material;
Number and type of items;
Amount of truck or trailer space required;
Disposal fees;
Recycling fees;
Transfer station or facility fees;
Special handling requirements;
Item dimensions;
Stairs;
Elevators;
Long carrying distances;
Parking limitations;
Difficult access;
Dismantling requirements;
Extremely heavy items;
Additional labor;
Additional time;
Unexpected debris;
Materials concealed beneath, inside, or behind other items;
Hazardous or restricted materials;
Special equipment;
Additional items requested after the original estimate; and
Conditions that were not reasonably apparent when the estimate was prepared.
If the actual scope of work materially differs from the information used to prepare an estimate, North State Hauling may provide a revised price before proceeding with the affected or additional work.
Customer may decline a revised estimate before the changed or additional work begins, subject to any applicable and previously disclosed trip, cancellation, minimum-service, or labor charges.
4. FINAL PRICING
Depending on the job, final pricing may be based on one or more of the following:
Volume of material actually removed;
Truck or trailer space used;
Weight;
Item type;
Labor required;
Time required;
Disposal costs;
Recycling costs;
Accessibility;
Special handling;
Equipment requirements;
Travel requirements;
Applicable surcharges; and
Other job-specific circumstances.
If North State Hauling provides a guaranteed or fixed written price for a specifically defined scope of work, that price will apply to that scope unless Customer requests additional work or materially different conditions are discovered.
Whenever reasonably practical, material pricing changes will be communicated to Customer before the affected additional work is performed.
5. CUSTOMER RESPONSIBILITY FOR ACCURATE INFORMATION
Customer agrees to provide accurate and reasonably complete information concerning the requested job.
Customer must inform North State Hauling in advance, when applicable, about:
Extremely heavy objects;
Safes;
Pianos;
Hot tubs;
Large appliances;
Exercise equipment;
Machinery;
Concrete;
Dirt;
Roofing materials;
Construction debris;
Chemicals;
Paint;
Fuel;
Oil;
Batteries;
Propane cylinders;
Refrigerants;
Asbestos or suspected asbestos-containing material;
Sharp objects;
Medical or biohazardous waste;
Animal or human waste;
Mold or potentially hazardous conditions;
Bed bugs;
Fleas;
Rodents;
Other infestations;
Stairs;
Elevators;
Difficult or unusual access conditions;
Parking restrictions; and
Any other circumstance that could reasonably affect the safety, legality, cost, or difficulty of the job.
Failure to disclose material conditions may result in a revised estimate, additional charges, postponement, or refusal of service.
6. CUSTOMER PRESENCE AND AVAILABILITY
Customer or an authorized adult representative should be present during the Services whenever reasonably possible.
If Customer will not be present, Customer is responsible for providing any necessary access and remaining reasonably available by telephone or text message while the Services are being performed.
If questions arise concerning the scope of work, items to be removed, access, pricing, or other material matters, North State Hauling may attempt to contact Customer or Customer’s authorized representative.
If we cannot reach Customer after reasonable attempts, North State Hauling may:
Pause the affected portion of the work;
Decline to remove questionable items;
Continue work that clearly falls within the previously authorized scope; or
Use reasonable judgment consistent with Customer’s previously provided instructions.
North State Hauling is not required to perform additional or materially different work without appropriate authorization.
7. SCHEDULING AND ARRIVAL WINDOWS
Appointment times and arrival windows are estimates unless North State Hauling expressly guarantees a specific time in writing.
Junk removal and hauling schedules may be affected by circumstances including:
Traffic;
Weather;
Wildfires;
Road closures;
Earlier jobs taking longer than anticipated;
Vehicle or equipment issues;
Disposal facility delays or closures;
Emergencies;
Employee availability; and
Other unexpected circumstances.
We will make reasonable efforts to communicate significant delays.
North State Hauling is not responsible for losses resulting solely from reasonable scheduling delays or rescheduling caused by circumstances outside our reasonable control, except where liability cannot legally be excluded.
8. PROPERTY ACCESS
Customer is responsible for providing reasonable, lawful, and safe access to the property (“Premises”) and the items to be removed.
Customer represents that Customer either:
Owns or lawfully controls the Premises; or
Has permission from the owner or other authorized person to allow North State Hauling to enter the Premises and perform the Services.
Customer should ensure that:
Gates, doors, and necessary access points are available;
Items intended for removal can be clearly identified;
Walkways and work areas are reasonably clear;
Known hazards are disclosed;
Necessary permissions have been obtained;
Children are kept away from active work areas; and
Pets are safely secured when necessary.
If North State Hauling cannot reasonably access the property or perform the Services because of conditions outside our control, we may reschedule, modify, or cancel the service.
Applicable trip, cancellation, or labor fees may apply if those fees were disclosed or agreed to beforehand.
9. PARKING AND LOADING ACCESS
Customer is responsible for providing reasonably safe and lawful parking and loading access for North State Hauling vehicles whenever reasonably possible.
Customer should disclose before the appointment any:
Parking restrictions;
Permit requirements;
Loading-zone restrictions;
Gated access;
Height restrictions;
Narrow driveways;
Steep driveways;
HOA restrictions;
Apartment or condominium loading requirements; or
Other conditions that could materially affect vehicle or crew access.
Additional labor or time charges may apply if unexpected access conditions materially increase the work required, provided such additional charges are communicated when reasonably practicable.
10. VEHICLE ACCESS TO LAWNS AND NON-PAVED AREAS
North State Hauling generally recommends that its vehicles remain on reasonably suitable paved driving surfaces.
If Customer requests or authorizes a North State Hauling vehicle to enter or drive upon a lawn, field, gravel area, dirt surface, soft ground, unpaved driveway, or other non-standard driving surface, Customer acknowledges that doing so may create increased risk of:
Rutting;
Cracking;
Sinking;
Soil displacement;
Damage to grass or landscaping;
Damage to irrigation systems;
Damage to septic systems;
Damage to underground utilities;
Damage to paving or other surfaces; and
Vehicle immobilization.
Customer is responsible for informing North State Hauling of known underground utilities, septic systems, irrigation systems, unstable surfaces, or other concealed conditions before authorizing vehicle access.
North State Hauling may refuse to drive onto any surface that we reasonably believe presents an unacceptable risk.
11. AUTHORITY TO REMOVE PROPERTY
By directing North State Hauling to remove an item, Customer represents and warrants that Customer:
Owns the item; or
Has sufficient legal authority and permission to authorize its removal.
Customer is responsible for clearly identifying which items should and should not be removed.
North State Hauling may rely upon instructions provided by Customer or Customer’s authorized representative at the property.
If there is uncertainty regarding ownership or authorization, North State Hauling may refuse to remove an item until the issue is resolved.
12. ITEMS DESIGNATED FOR REMOVAL
Before authorizing removal, Customer is responsible for inspecting all items and removing any belongings Customer intends to keep.
This includes, without limitation:
Cash;
Jewelry;
Identification documents;
Passports;
Financial documents;
Legal documents;
Personal records;
Prescription medications;
Keys;
Electronic devices;
Photographs;
Family heirlooms;
Collectibles;
Firearms or ammunition;
Sensitive information;
Important paperwork; and
Other valuable or irreplaceable property.
Once an item has been clearly designated for removal, loaded by North State Hauling, and taken into our possession, Customer acknowledges that it may be transported, sorted, donated, recycled, transferred, salvaged, disposed of, or otherwise lawfully handled.
To the extent permitted by applicable law, Customer’s ownership interest in an item designated and accepted for removal transfers to North State Hauling when North State Hauling takes possession of and loads that item for removal.
Customer should verify before our crew leaves that only the intended items have been removed.
If Customer believes an item was removed by mistake, Customer should contact North State Hauling immediately.
We may make reasonable efforts to locate the item, but recovery cannot be guaranteed after an item has been loaded, transported, transferred, donated, recycled, or disposed of.
13. PROHIBITED AND RESTRICTED MATERIALS
North State Hauling reserves the right to refuse any material that we cannot safely or legally handle, transport, recycle, or dispose of.
Prohibited or restricted materials may include:
Hazardous waste;
Explosives;
Ammunition;
Fireworks;
Gasoline;
Diesel fuel;
Certain oils and automotive fluids;
Flammable liquids;
Certain chemicals;
Solvents;
Pesticides;
Certain paints;
Medical waste;
Biohazardous waste;
Radioactive materials;
Certain compressed-gas cylinders;
Asbestos or suspected asbestos-containing material;
Contaminated soil;
Infectious materials;
Unknown chemicals;
Materials contaminated with hazardous substances; and
Any material North State Hauling reasonably determines cannot safely or legally be transported.
Certain materials—including electronics, batteries, appliances containing refrigerants, tires, mattresses, and similar items—may be accepted only under particular conditions and may involve additional disposal or recycling charges.
Customer must disclose known hazardous or restricted materials before service.
North State Hauling may stop work immediately if suspected hazardous, dangerous, contaminated, or prohibited materials are discovered.
14. CONCEALED HAZARDOUS MATERIALS
Customer must not knowingly conceal or place prohibited, hazardous, flammable, toxic, or otherwise restricted materials inside bags, boxes, containers, furniture, debris piles, trash, or other materials without disclosing them to North State Hauling.
If undisclosed hazardous or prohibited materials leak, spill, contaminate other materials, damage equipment, require specialized cleanup, or result in governmental or disposal-facility charges, Customer may be responsible, to the extent permitted by law, for reasonable costs resulting from Customer’s knowing or negligent failure to disclose those materials.
Such costs may include:
Specialized cleanup;
Remediation;
Disposal;
Decontamination;
Equipment cleaning;
Facility charges;
Governmental fees; and
Other reasonable expenses directly resulting from the undisclosed materials.
15. INFESTED OR CONTAMINATED ITEMS
Customer must disclose known or suspected infestations or contamination before service.
Examples include:
Bed bugs;
Fleas;
Lice;
Cockroaches;
Rodents;
Animal waste;
Human waste;
Mold;
Sewage;
Biological contamination; and
Other conditions that may create health or safety concerns.
North State Hauling may refuse affected materials, require additional protective measures, revise the price, or stop work if such conditions are discovered.
Additional handling or disposal charges may apply when disclosed and approved before the affected work proceeds.
16. HEAVY, OVERSIZED, OR DIFFICULT ITEMS
Certain items may require additional personnel, equipment, dismantling, preparation, or specialized removal procedures.
Examples include:
Safes;
Pianos;
Hot tubs;
Large exercise equipment;
Commercial equipment;
Machinery;
Oversized furniture;
Large appliances;
Concrete;
Stone; and
Other unusually heavy or difficult materials.
North State Hauling may decline to move an item if we determine that doing so presents an unreasonable risk of injury, property damage, equipment damage, or violation of law.
Additional charges may apply when the nature or condition of an item was not adequately disclosed before the estimate.
17. UTILITIES AND ITEM DISCONNECTION
Unless North State Hauling expressly agrees otherwise, Customer is responsible for ensuring that appliances, equipment, and other items are properly disconnected before removal when professional disconnection is required.
Customers should arrange qualified professionals where appropriate for:
Gas lines;
Electrical connections;
Plumbing connections;
Refrigerant systems;
Permanently installed equipment;
Structural attachments; and
Other licensed or specialized work.
North State Hauling does not represent that its junk-removal personnel are licensed electricians, plumbers, HVAC technicians, gas technicians, hazardous-material contractors, or other specialized tradespeople unless expressly stated otherwise.
We may refuse to remove an item that has not been safely disconnected.
18. PETS, CHILDREN, AND WORK AREA SAFETY
Customer is responsible for keeping children, pets, guests, and other persons reasonably clear of active work areas.
We recommend that pets be secured while large or heavy items are being moved and while exterior doors, gates, garages, or other access points are open.
North State Hauling is not responsible for a pet escaping solely because Customer failed to reasonably secure the pet during the Services, except to the extent liability results from North State Hauling’s negligence or other conduct for which liability cannot legally be excluded.
19. PROPERTY PROTECTION AND PREEXISTING CONDITIONS
North State Hauling will use reasonable care while performing Services.
Junk removal frequently involves moving large, heavy, awkward, or bulky objects through homes, garages, yards, hallways, stairways, doorways, elevators, and confined areas.
Customer agrees to disclose known fragile, damaged, or unusually vulnerable property conditions before work begins.
These may include:
Damaged flooring;
Loose railings;
Weak stairs;
Cracked concrete;
Damaged walls;
Narrow doorways;
Unstable structures;
Fragile landscaping;
Underground utilities;
Septic systems;
Irrigation systems;
Recently installed flooring;
Fragile gates or fences; and
Other existing damage or unusual conditions.
North State Hauling is not responsible for preexisting damage, ordinary deterioration, or damage not caused by our negligence or wrongful conduct.
Nothing in these Terms is intended to exclude responsibility that cannot lawfully be excluded.
20. CUSTOMER-PERFORMED PREPARATION
If Customer chooses to dismantle, disconnect, drain, empty, move, package, or otherwise prepare an item before our arrival, Customer is responsible for performing that preparation safely and correctly.
North State Hauling is not responsible for damage caused by improper customer-performed disconnection, dismantling, packaging, or preparation except to the extent North State Hauling independently causes additional damage through negligence or wrongful conduct.
21. RIGHT TO REFUSE OR STOP SERVICE
North State Hauling may refuse, suspend, modify, or stop work when we reasonably believe:
Conditions are unsafe;
Performing the work may violate applicable law;
Hazardous or prohibited materials are present;
Customer materially misrepresented the job;
Customer or another person is threatening, abusive, violent, discriminatory, or materially interfering with safe work;
Animals create an unsafe working environment;
The property appears structurally unsafe;
Required access is unavailable;
Required authorization cannot be established;
The requested work materially differs from the agreed scope;
Appropriate equipment or personnel are unavailable; or
Continuing would create an unreasonable risk to people, property, vehicles, or equipment.
Customer remains responsible for authorized work already performed and reasonable expenses already incurred.
22. PAYMENT
Unless otherwise agreed in writing, payment is due immediately upon completion of the Services.
North State Hauling may accept payment through methods we make available.
Certain jobs may require:
A deposit;
Advance payment;
Card authorization; or
Other payment arrangements.
Customer agrees to pay all charges Customer has authorized.
Applicable taxes, government charges, disposal fees, recycling fees, and other agreed charges may be added where appropriate.
Commercial customers or other approved customers may be permitted to pay by invoice pursuant to separate payment terms.
23. PAST-DUE BALANCES AND COLLECTIONS
Past-due balances may be referred for collection.
To the extent permitted by applicable law and the applicable service agreement, Customer may be responsible for reasonable costs incurred in collecting an undisputed past-due balance.
Nothing in this provision permits North State Hauling to recover fees or expenses prohibited by applicable law.
24. CANCELLATIONS AND RESCHEDULING
We understand that plans change.
Customers should contact North State Hauling as soon as reasonably possible when an appointment needs to be cancelled or rescheduled.
North State Hauling may establish cancellation requirements for standard appointments, large cleanouts, dedicated crew bookings, or other projects.
Any cancellation fee, rescheduling fee, deposit requirement, or required notice period applicable to a particular booking should be disclosed before the booking is finalized or otherwise agreed to by Customer.
North State Hauling may cancel or reschedule an appointment because of:
Severe weather;
Unsafe conditions;
Wildfires;
Road closures;
Vehicle or equipment problems;
Staffing emergencies;
Disposal facility closures;
Government restrictions;
Emergencies; or
Other circumstances that reasonably prevent us from performing the Services.
If North State Hauling cancels a prepaid service and the service is not rescheduled, any refund owed will be handled in accordance with the applicable agreement and law.
Nothing in this section limits cancellation rights that applicable law gives a consumer.
25. DEPOSITS
Certain large jobs, cleanouts, special projects, jobs requiring dedicated crews, or jobs requiring substantial scheduling commitments may require a deposit.
Any required deposit amount and applicable cancellation or refund conditions will be disclosed before the deposit is collected.
Unless expressly stated otherwise in writing, paying a deposit does not prevent North State Hauling from revising the remaining price when the actual job materially differs from the scope represented when the estimate was prepared.
26. DONATION, RECYCLING, SALVAGE, AND DISPOSAL
North State Hauling may make reasonable efforts to donate, recycle, reuse, repurpose, salvage, or otherwise divert usable materials from disposal when practical.
However, North State Hauling does not guarantee that any particular item will be donated, recycled, or reused.
Whether an item can be donated or recycled may depend upon:
Item condition;
Contamination;
Bed bugs or other infestations;
Donation center policies;
Recycling facility requirements;
Available organizations;
Facility operating hours;
Transportation requirements;
Market conditions;
Weather;
Disposal regulations;
Cost;
Safety considerations; and
Practical feasibility.
Unless specifically agreed otherwise, North State Hauling determines the lawful destination and handling method for items after taking possession of them.
27. NO GUARANTEE REGARDING DONATIONS OR TAX DEDUCTIONS
North State Hauling does not provide tax, accounting, or legal advice.
We do not guarantee:
That an item will be donated;
That a donation organization will accept an item;
That a donation will qualify for a tax deduction;
The value of any donated item; or
That any particular tax documentation will be available.
Customers should consult their own tax professional regarding charitable deductions or documentation.
28. PHOTOGRAPHS AND JOB DOCUMENTATION
North State Hauling may take reasonable photographs or video recordings before, during, or after a job for legitimate operational purposes, including:
Documenting the items presented for removal;
Documenting preexisting property conditions;
Documenting completed work;
Quality control;
Safety;
Employee training;
Resolving customer questions or disputes; and
Maintaining business records.
We will make reasonable efforts to avoid unnecessarily capturing sensitive personal information.
Operational documentation will be handled in accordance with our Privacy Policy and applicable law.
Marketing Use
North State Hauling may separately request permission to use photographs, videos, testimonials, or other customer-related content for advertising, social media, Website content, or other promotional purposes.
Where consent is required by applicable law, we will obtain appropriate consent before publicly using identifiable customer information or identifiable private-property content for marketing purposes.
Customers may tell North State Hauling if they do not want nonessential photographs or videos taken during their appointment.
North State Hauling recognizes that estate cleanouts, hoarding situations, personal transitions, and similar projects can involve sensitive circumstances, and we intend to exercise appropriate discretion when documenting such work.
29. THIRD-PARTY SERVICES
Our Website or Services may use or link to third-party services, including:
Payment processors;
Scheduling platforms;
Mapping services;
Review websites;
Social media platforms;
Donation organizations;
Recycling facilities;
Disposal facilities; and
Other service providers.
North State Hauling does not control third-party websites or their independent practices.
Use of a third-party service may be subject to that provider’s separate terms and privacy policies.
30. WEBSITE FORMS AND ELECTRONIC COMMUNICATIONS
When Customer submits a quote request, contact form, booking request, text message, email, or other electronic communication, Customer authorizes North State Hauling to use the information provided to respond to and administer the applicable request or service, subject to our Privacy Policy and applicable law.
Submitting a form does not guarantee availability, pricing, scheduling, or acceptance of a job.
31. TEXT MESSAGES AND PHONE COMMUNICATIONS
If Customer provides a telephone number in connection with a quote, appointment, or service request, North State Hauling may use that number to communicate regarding the applicable request or service as permitted by law.
Service-related communications may include:
Quote questions;
Appointment confirmations;
Scheduling;
Arrival updates;
Access questions;
Estimate revisions;
Payment information; and
Service follow-up.
Any separate marketing communications will be handled in accordance with applicable consent requirements.
32. WEBSITE ACCEPTABLE USE
You agree not to:
Use the Website for unlawful purposes;
Attempt to gain unauthorized access to the Website or related systems;
Introduce viruses, malware, or malicious code;
Interfere with Website operation;
Scrape or harvest information through unauthorized automated means;
Impersonate another person;
Submit intentionally false or fraudulent information;
Use the Website to harass or harm another person; or
Attempt to circumvent Website security measures.
North State Hauling may restrict access to the Website if we reasonably believe these Terms have been violated.
33. INTELLECTUAL PROPERTY
Unless otherwise indicated, the Website and its original content—including text, graphics, branding, logos, photographs, videos, layouts, and other materials—are owned by or licensed to North State Hauling and are protected by applicable intellectual-property laws.
You may use the Website for your personal, noncommercial purpose of learning about or purchasing our Services.
You may not reproduce, distribute, sell, republish, modify, or commercially exploit our Website content without prior written permission except as permitted by law.
34. CUSTOMER REVIEWS AND SUBMITTED CONTENT
If Customer voluntarily submits a review, testimonial, photograph, video, or other content directly to North State Hauling for promotional use, Customer represents that Customer has the right to provide that content.
North State Hauling will obtain any additional permission required by applicable law before using customer-submitted material when such permission is legally required.
Nothing in these Terms requires a customer to provide a review or testimonial.
35. WEBSITE AVAILABILITY
North State Hauling does not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
We may modify, suspend, discontinue, or update portions of the Website without notice.
We are not responsible for temporary Website unavailability caused by maintenance, hosting providers, internet outages, cybersecurity incidents, or circumstances outside our reasonable control.
36. EVENTS BEYOND OUR REASONABLE CONTROL
North State Hauling will not be responsible for delays or failures to perform caused by circumstances outside our reasonable control, to the extent permitted by applicable law.
Such circumstances may include:
Wildfires;
Fires;
Floods;
Earthquakes;
Severe weather;
Natural disasters;
Road closures;
Transportation interruptions;
Disposal or recycling facility closures;
Government orders;
Public emergencies;
Utility failures;
Significant vehicle or equipment failures;
Labor shortages or disruptions;
Epidemics or public-health emergencies; and
Other comparable circumstances beyond our reasonable control.
When such an event occurs, North State Hauling may reschedule, modify, suspend, or cancel affected Services as reasonably necessary.
This section does not excuse obligations that applicable law does not permit us to exclude.
37. DISCLAIMER OF WEBSITE WARRANTIES

This disclaimer does not eliminate warranties or consumer rights that cannot legally be waived.
38. LIMITATION OF LIABILITY
North State Hauling intends to perform its Services with reasonable care.
To the maximum extent permitted by applicable law, North State Hauling will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the Website or Services when such damages may lawfully be excluded.
North State Hauling is not responsible for losses resulting from:
Customer’s failure to disclose hazardous or prohibited materials;
Customer’s lack of authority to authorize removal;
Customer’s inaccurate identification of items for removal;
Preexisting property damage;
Customer’s failure to disclose known dangerous or unusual property conditions;
Improper customer-performed disconnection or preparation;
Customer-requested access to unsuitable areas, except to the extent caused by North State Hauling’s negligence or wrongful conduct; or
Circumstances outside North State Hauling’s reasonable control.
Nothing in these Terms is intended to exclude or limit liability for:
Fraud;
Willful misconduct;
Gross negligence where liability cannot legally be limited;
North State Hauling’s negligence where applicable law prohibits limitation;
Violation of non-waivable consumer rights; or
Any other liability applicable law prohibits us from excluding or limiting.
Any limitation of liability applies only to the extent permitted by law.
39. CUSTOMER RESPONSIBILITY AND INDEMNIFICATION
To the extent permitted by applicable law, Customer agrees to be responsible for claims, losses, penalties, damages, or reasonable expenses arising from:
Customer’s intentional or unlawful conduct;
Customer’s material violation of these Terms;
Customer’s lack of authority to authorize removal of property;
Materially false information Customer knowingly provides concerning a job;
Customer’s knowing or negligent failure to disclose hazardous or prohibited materials;
Customer’s knowing failure to disclose a dangerous property condition when disclosure was reasonably necessary for safe performance; or
A third party’s ownership claim concerning property Customer represented that Customer had authority to remove.
To the extent permitted by applicable law, Customer agrees to indemnify and hold North State Hauling harmless from third-party claims directly resulting from such conduct.
This provision does not require Customer to indemnify North State Hauling for losses caused by North State Hauling’s own negligence, willful misconduct, or other wrongful conduct where such indemnification is prohibited by law.
40. RELEASE OF INFORMATION REQUIRED BY LAW
North State Hauling may disclose customer, service, property, or removed-material information when we reasonably believe disclosure is required by applicable law, court order, subpoena, governmental authority, law enforcement request, regulatory requirement, or other legally valid process.
Any such disclosure will be handled in accordance with applicable law and our Privacy Policy.
41. DISPUTES
If a concern arises regarding our Services, Customer is encouraged to contact North State Hauling promptly so that we have an opportunity to investigate and attempt to resolve the issue.
Before initiating formal litigation, the parties may voluntarily attempt to resolve a dispute through good-faith communication or another mutually agreed dispute-resolution process.
Nothing in these Terms prevents either party from exercising rights available in small claims court or other rights that cannot lawfully be waived.
These Terms do not impose mandatory arbitration or a jury-trial waiver unless North State Hauling separately adopts a legally reviewed agreement containing such provisions.
42. GOVERNING LAW
These Terms and the applicable Agreement are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law is legally required to apply.
Any dispute concerning these Terms will be handled by a court or other forum having lawful jurisdiction over the dispute.
43. CONSUMER RIGHTS
Nothing in these Terms is intended to waive, restrict, or eliminate any consumer protection, warranty, cancellation right, remedy, or other right that cannot lawfully be waived under California or federal law.
If a provision of these Terms conflicts with a mandatory consumer-protection law, the applicable law controls.
44. CHANGES TO THESE TERMS
North State Hauling may update these Terms periodically to reflect changes in our Services, business practices, Website, or applicable legal requirements.
When changes are made, we may update the “Last Updated” date at the top of this page.
Changes apply prospectively from the effective date of the updated Terms unless applicable law requires otherwise.

45. SEVERABILITY

If it cannot be made enforceable, it will be severed without affecting the remaining provisions.
46. NO WAIVER
Failure by North State Hauling to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.
47. ASSIGNMENT AND SUCCESSORS
To the extent permitted by applicable law, these Terms and any applicable service agreement will be binding upon and benefit the parties and their permitted successors and assigns.
Customer may not transfer a service agreement to another person without North State Hauling’s consent when the identity of the customer or property is material to the Services.
48. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy where applicable and any estimate, work order, invoice, booking confirmation, written proposal, or other service-specific terms accepted in connection with a particular job, constitute the applicable agreement concerning Customer’s use of the Website and our Services.
If a job-specific written agreement expressly conflicts with these Terms, the job-specific agreement controls with respect to that job to the extent of the conflict.
No oral statement by an employee or representative modifies these Terms or a written estimate unless the modification is authorized and agreed to by North State Hauling.

CUSTOMER SERVICE AGREEMENT ACKNOWLEDGMENT
When these Terms are incorporated into an estimate, work order, booking, or other service agreement, Customer’s approval of the applicable agreement and authorization for North State Hauling to begin work constitutes Customer’s acknowledgment of these Terms to the extent permitted by applicable law.
Customers are encouraged to review these Terms before approving an estimate or authorizing work.
